Article 1 – General

These General Terms and Conditions of Sale define, in particular, the conditions of ordering, payment, delivery, and management of any returns of products ordered by customers on the website endovivo.com. Placing an order on the website endovivo.com for one or more products, selecting and validating a payment method during the ordering process implies prior consultation of these General Terms and Conditions of Sale and the automatic, irrevocable, and unconditional acceptance by the customer of these terms.

Accordingly, the customer acknowledges being fully informed that their agreement to the content of these General Terms and Conditions of Sale does not require a handwritten signature, insofar as the customer wishes to order the products presented online.

No specific conditions may, unless formally accepted in writing by ENDOVIVO PRODUCTIONS, prevail over these General Terms and Conditions of Sale. The fact that ENDOVIVO PRODUCTIONS does not enforce, at any given time, any provision of these terms shall not be interpreted as a waiver of its right to enforce such provision at a later date. ENDOVIVO PRODUCTIONS reserves the right to modify these General Terms and Conditions of Sale at any time, provided that such modifications are published on the website endovivo.com.

Article 2 – General Description of Products

In order to enable the customer to know the products they wish to purchase before placing an order, and in accordance with Article L111-1 of the French Consumer Code, ENDOVIVO PRODUCTIONS presents on the website endovivo.com the characteristics of the books and DVDs offered for sale.

Furthermore, the customer may at any time contact ENDOVIVO PRODUCTIONS by email, telephone, or post to obtain additional information regarding the products and services offered.

The texts and photographs describing and illustrating the products are not contractually binding. Consequently, ENDOVIVO PRODUCTIONS shall not be held liable in the event of an error in any such photograph or text. ENDOVIVO PRODUCTIONS reserves the right to modify, without prior notice, the products or their characteristics on the website endovivo.com. The selection and purchase of a product are the sole responsibility of the customer.

Article 3 – Prices

The sale prices of the products displayed on the website are in Euros (€), all taxes included (TTC). Delivery costs are borne by the customer and are indicated at the time of order validation. Delivery costs vary depending on the type of products ordered.

The customer will always be informed, prior to final confirmation of the order, of the delivery costs associated with it, and payment will be requested for the total amount of the purchase. Accordingly, the selection and validation of a payment method implies acceptance of the applicable delivery costs. Delivery costs cannot constitute a valid reason to dispute an order after its final confirmation.

Article 4 – Orders

Orders placed on the website endovivo.com are binding upon the customer. Any order will be confirmed by sending a confirmation email to the customer.

Article 5 – Shipping and Carrier

Products are shipped as soon as possible once their manufacture has been completed. A shipment confirmation email is automatically sent to the customer.

Shipping is carried out by La Poste via tracked Colissimo delivery with signature required, or by Mondial Relay with various delivery options (pickup points or home delivery), depending on the destination country (France, Belgium, Luxembourg, the Netherlands, Germany, Austria, Italy, Spain, Portugal).

Article 6 – Receipt of Goods

Upon receipt of the package, it is the customer’s responsibility to check its condition and make any reservations deemed necessary with the carrier.

Claims relating to apparent defects, damage (not attributable to the carrier), or non-conformity of the delivered product must be submitted within 48 hours of receipt of the package, by email to: contact@endovivo.com. The customer must provide all supporting evidence proving the existence of the defects or anomalies observed.

Any claim not made in accordance with the above rules will not be taken into account and will release ENDOVIVO PRODUCTIONS from any liability towards the customer.

Article 7 – Right of Withdrawal

Given the nature of our products, and in accordance with Article L.221-5 of the French Consumer Code, our BOOKS and DVDs are not subject to any right of withdrawal. Products cannot be returned or exchanged.

Article 8 – Invoicing

After order confirmation, a detailed invoice is available for viewing and printing by the customer directly on the website endovivo.com in the “My Account” section.

Article 9 – Payment Terms and Security

Payment of the total amount corresponding to the product or service ordered, including delivery costs, is due in full by credit card, PayPal, or bank transfer at the time the order is finalized, i.e., upon receipt of the order confirmation.

For this purpose, the customer must provide the required information as indicated on the website for each order. No order will be accepted or confirmed until the required payment information has been provided and validated.

Payment by credit card is processed via the secure banking servers of our partners PayPal and Stripe.

Article 10 – Personal Data

The information requested from the customer is necessary for processing their order and may be communicated to ENDOVIVO PRODUCTIONS’ contractual partners involved in fulfilling the order.

Unless expressly opposed, the customer consents to the use of the personal data collected during the order for the customer database of ENDOVIVO PRODUCTIONS. In accordance with French Law No. 78-17 of January 6, 1978 relating to data processing, files, and freedoms, the customer has the right to access and rectify their data at any time. These General Terms and Conditions of Sale are governed, both in their interpretation and execution, by French law. In the event of a dispute, the customer shall first contact ENDOVIVO PRODUCTIONS to seek an amicable solution.

Any dispute relating to the formation, performance, or termination of contractual obligations between the parties that cannot be resolved amicably shall be submitted to the jurisdiction of the Commercial Court of Bordeaux, within whose jurisdiction the seller’s registered office is located.
